Freedom of information act. Insurance company?
Can I file a freedom of information act against AAA refuses to pay me for damages, but also refuses to tell me what facts they have to deny me payment. they are also trying to charge me for 50% of damages and the lady came into a roundabout without stopping or yielding and hit me! So I asked what information they have about laws or whatever that puts me at fault. the adjuster stay silent. Can I file a freedom of information act request and force them to provide facts (that Do not exist) to prove my case?
No. FOIA does not apply to this.
If you disagree with the adjusters liability decision - you can call and speak to their supervisor. Or you can file a complaint with your state's department of insurance. Or you can file a claim with your own insurance company. If you have collision coverage- your company can settle with you and then file arbitration against the other company to try and get paid back.
Of the 3, filing with your own company and letting them handle it would be the easiest.
