the second one,
you need to try and stay away from background colours that are to bold, also be careful with text colour and ensure it is on an appropriate background, you need to make sure all text is legible and in an appropriate size. You also need to try and make sure your website is accessible to disabled people as possible this includes colour blindness, etc (it is now against the law to discriminate against disabled people under the DDA all websites now have to conform to WCAG, this means that if a disabled person feels they cannot use your website then they are allowed to sue)
I think the font style needs changing is to curvey and people might find it hard to read.
Don't use purple as a font colour only black
If your selling stuff directly from the website you need to make sure the site is secure
try to stick to only one or two different font styles and colours as you need to be consisitant

Yes the black and green is better but you just need to be careful the background doesnt distract your customers.
I would stay away from spots option for a background
The font style on the navigation is also to curvey and would need changing to a more straight font that is easier to read.
When you buy templates they can normally be edited though so minor changes could be made if you know what your doing.
